These Terms of Service ("Terms") govern your use of services provided by Asymmetric.al ("we", "us", or "our"). By using our services, you agree to these Terms. Effective Date: April 2, 2026.

Acceptance of Terms

You accept these Terms by:

• Using the donor application
• Creating an account
• Submitting or attempting to submit a donation
• Starting or managing a recurring giving schedule
• Using related dashboard or support features

Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• We reserve the right to terminate or suspend accounts at our discretion.

Prohibited Uses

You may not use our services for the following purposes:

• Violating applicable law or the rights of others
• Attempting to gain unauthorized access to accounts, systems, or data
• Interfering with platform security, availability, or integrity
• Using the service for fraudulent, deceptive, or abusive conduct

Payments

• Some features of our services require payment.
• Donations are generally final once processed. We review reversal requests for duplicate, mistaken, or unauthorized transactions, and may review a narrow set of exceptional cases involving clear processing errors in our sole discretion. If a confirmed error is approved for refund, we aim to issue it within 28 days and, where possible, return it to the original payment method. We may request reasonable information to verify the request. Any approved reversal may affect tax records and year-end giving receipts.

Service Availability

• We do not guarantee uninterrupted or error-free access to our services.

Termination

• We may terminate or suspend your access to our services at any time, with or without cause or notice.
• You may terminate your use of our services at any time.
• Access to authenticated donor features may end immediately where required for security, abuse prevention, legal compliance, or platform operations. Donation, payment, audit, and related records may still be retained where needed for accounting, security, legal obligations, or dispute handling.

Disclaimers

• Our services are provided on an "as is" and "as available" basis.
• We make no warranties, express or implied, regarding the reliability, accuracy, or fitness for a particular purpose of our services.

Limitation of Liability

• To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages.
• To the maximum extent permitted by law, our aggregate liability arising out of or relating to the hosted and support services will not exceed the greater of the amounts paid for those services in the 12 months before the event giving rise to the claim or US $100. This limitation does not apply where liability cannot be limited under applicable law, including for fraud, willful misconduct, gross negligence, or other non-waivable liabilities.

Third-Party Services

Our services may integrate with or link to third-party services:

• Vercel Inc. — Provides application hosting, deployments, edge/network delivery, and managed infrastructure for the hosted service.
• Supabase Inc. — Provides authentication, database, storage, and backend platform services for the hosted service.
• Stripe, LLC — Provides payment processing, donation checkout, recurring billing, and related financial transaction handling.
• Plus Five Five, Inc. d/b/a Resend — Provides transactional email delivery, webhook processing, inbound email handling, suppression management, and related email infrastructure.
• Unlayer, Inc. — Provides embedded email and PDF builder features where those features are enabled.

Dispute Resolution

• Any disputes arising from these Terms or your use of our services shall be resolved through litigation.
• Venue: The parties agree to the exclusive jurisdiction of the state courts located in Placer County, California, and, where federal jurisdiction applies, the federal courts serving Placer County, California..

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice via Posting updates on this page or through the service before changes take effect. Continued use of our services after changes constitutes acceptance of the revised Terms.
